Scott W. Foley is a partner in the Firm’s Bankruptcy and Financial Restructuring Department. He regularly represents secured and unsecured creditors as well as trustees in bankruptcy cases. He handles related litigation in state courts and federal bankruptcy courts in Maryland, the District of Columbia, Virginia, Delaware, and other jurisdictions.  

Mr. Foley has successfully represented finance companies and other secured lenders in numerous major bankruptcy cases involving relief from automatic stays, avoidance actions, discharge litigation, use of cash collateral, and plan confirmation issues.  

He has also obtained favorable results for financial services institutions in:

  • Commercial loan workouts and restructurings;
  • Re-documenting troubled loans;
  • Loan participation and other inter-creditor disputes;
  • Foreclosures and secured creditor sales;
  • Lender liability matters; and
  • Fraudulent conveyances and other commercial collection matters.  

Mr. Foley has extensive experience in a wide range of commercial matters. On behalf of lenders, he has handled asset-based financing arrangements involving loans secured by shopping centers, hotels, mixed-used commercial properties, rental properties, condominium complexes, sizable tracts of raw development land, and historic properties. His commercial and complex business litigation experience also includes construction and mechanic’s lien litigation, commercial landlord/tenant disputes, and other general contract disputes.

Before entering private practice, Mr. Foley served as Judicial Law Clerk to the Honorable Edward A. DeWaters, Jr., a former Chief Judge of the Circuit Court of Maryland for Baltimore County. An active member of bar associations, Mr. Foley serves on the board of The Franciscan Center and The Homeland Association.
