Richard M. Goldberg is a partner concentrating in bankruptcy, creditors' rights, workouts, and commercial litigation. Mr. Goldberg focuses his practice on corporate reorganizations, creditors’ rights in Chapter 11 bankruptcy cases, representation of creditors’ committees and trustees in bankruptcy cases, and out of court workouts. Mr. Goldberg has considerable experience representing debtors, trustees, creditors’ committees, creditors, financial institutions, landlords, and specialty lending institutions in all aspects of Chapter 11 reorganization cases, Chapter 11 liquidations, and large Chapter 7 liquidations. He has also successfully represented numerous parties seeking to acquire assets from bankruptcy estates. In addition to his experience in traditional bankruptcy related areas, Mr. Goldberg has extensive experience representing parties in commercial litigation matters, including disputes regarding the Uniform Commercial Code, in state and federal courts and in the appellate courts of Maryland and the Fourth Circuit Court of Appeals.
Mr. Goldberg serves as lead counsel to the Chapter 7 trustee of Regency Homes Corporation and twelve of its subsidiaries in the liquidation of the companies. Regency Homes was, until its demise, one of the largest independent homebuilders in Maryland and Virginia. At the time of its filing, Regency had more than $50 million in claims against it, including approximately $35 million in secured debt. Mr. Goldberg successfully negotiated and consummated several sales of Regency Homes’ assets that resulted in the reduction of secured and unsecured claims of approximately $35 million.
Mr. Goldberg successfully represented the Sheehy Automotive group in its contested purchase of substantially all of the assets of Annapolis Nissan from Annapolis Nissan’s Chapter 7 trustee.
Mr. Goldberg also successfully represented Gallery Corp, a subsidiary of mattress giant The Simmons Company, in its acquisition of a chain of mattress stores in California.
Additionally, along with his partner Joel I. Sher, Mr. Goldberg served as counsel to the official committee of unsecured creditors of Creditrust Corporation in a case where Messrs. Sher and Goldberg successfully negotiated and implemented a plan of reorganization with the debtor and several other constituencies. The case resulted in creditors being paid 100% of their claims, plus interest, in cash.
In other high profile matters, Mr. Goldberg represents the Baltimore-based bookstore chain Bibelot in its Chapter 11 case, and the Litigation Trustee appointed in the Railworks Corporation bankruptcy case involving the largest railroad products and services company in the country.
